HIPAA Notice of Privacy Practices

ANK Behavioral Health LLC ("ANK Behavioral Health," "we," "us," or "our") is required by law to maintain the privacy of your protected health information ("PHI"), to provide you with this notice of our legal duties and privacy practices, and to follow the terms of the notice currently in effect. PHI is information that may identify you and that relates to your past, present, or future physical or mental health, care, or payment for care.

1. How we may use and disclose your PHI

We may use and disclose your protected health information, without your separate authorization, for the following purposes:

Treatment

We may use your PHI to provide, coordinate, or manage your psychiatric care, including sharing information with other providers involved in your treatment, such as a therapist or primary care provider, when appropriate.

Payment

We may use and disclose your PHI to obtain payment for services, including verifying insurance benefits and processing claims through our billing partner for eligible commercial plans.

Health care operations

We may use and disclose your PHI for operations such as quality review, staff evaluation, scheduling, and administrative functions that support your care.

Business associates

We may share your PHI with third parties that perform services on our behalf, such as our scheduling portal, billing partner, and secure telehealth platform. These business associates are required by written agreement to protect your PHI.

2. Uses and disclosures that may be required or permitted by law

We may use or disclose your PHI without your authorization when required or permitted by law, including:

• When required by federal, state, or local law.
• For public health activities, or to prevent a serious and imminent threat to health or safety.
• To report suspected abuse, neglect, or domestic violence as required by law.
• For health oversight activities, judicial and administrative proceedings, or law enforcement purposes as permitted by law.
• To coroners, medical examiners, or as otherwise authorized by law.

Uses and disclosures not described in this notice will be made only with your written authorization. You may revoke an authorization in writing at any time, except to the extent we have already relied on it.

3. Special protections and appointment communications

Certain categories of information, including some mental health and substance use records, may receive additional protection under federal or New Jersey law, and we will follow those stricter requirements where they apply.

We may contact you to provide appointment reminders, confirmations, or information about your care using the phone number or email you provide. All telehealth visits are conducted over a secure, HIPAA-compliant video platform.

4. Your rights regarding your PHI

You have the following rights with respect to your protected health information:

• Right to access. You may inspect and request a copy of your PHI that we maintain, subject to certain limited exceptions.
• Right to amend. You may request that we correct PHI you believe is inaccurate or incomplete. We may deny the request in certain circumstances.
• Right to an accounting of disclosures. You may request a list of certain disclosures we have made of your PHI.
• Right to request restrictions. You may request limits on how we use or disclose your PHI. We are not required to agree to all requests, but we will honor a request to restrict disclosure to a health plan when you pay for a service in full out of pocket, as required by law.
• Right to confidential communications. You may request that we contact you in a specific way or at a specific location.
• Right to a paper copy. You may request a paper copy of this notice at any time, even if you agreed to receive it electronically.
• Right to be notified of a breach. You have the right to be notified if a breach of your unsecured PHI occurs.

5. Our responsibilities

We are required by law to:

• Maintain the privacy and security of your protected health information.
• Provide you with this notice of our legal duties and privacy practices.
• Follow the terms of the notice currently in effect.
• Notify you if a breach occurs that may have compromised the privacy or security of your PHI.

6. Complaints

If you believe your privacy rights have been violated, you may file a complaint with ANK Behavioral Health and with the Secretary of the U.S. Department of Health and Human Services, Office for Civil Rights. You will not be penalized or retaliated against for filing a complaint.

7. Changes to this notice

We reserve the right to change this notice and to make the revised notice effective for PHI we already have as well as any information we receive in the future. The current notice will be posted on this website with its effective date. We encourage you to review it periodically.
